Welcome to AI Video Generator!
These Terms of Service ("Terms") govern your access to and use of the mobile application AI Video Generator (the "App"), provided and operated by TYCHE CONSULTANTS LTD ("we," "us," or "our").
By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install, access, or use the App.
1. Description of Service
AI Video Generator is an artificial intelligence-driven mobile application that enables users to generate, edit, and create video content using photos, text prompts, video clips, and other media inputs.
The App offers both free features and paid options, including one-time purchases (e.g., credit/token packs) and recurring subscription services.
2. Eligibility and Account
Age Requirement: You must be at least 13 years of age (or 16 years of age in the European Economic Area or United Kingdom) to use the App. If you are under the legal age of majority in your jurisdiction, you must have the permission and supervision of a parent or legal guardian.
Device Responsibility: You are responsible for maintaining the security of your device and for all activities that occur under your App installation.
3. Subscriptions and In-App Purchases
A. One-Time Purchases
We may offer one-time purchases (such as video generation credits, tokens, or one-time premium feature passes).
All one-time purchases are non-refundable and non-transferable, except as required by applicable law or Google Play policies.
B. Subscriptions (Auto-Renewable)
Billing & Renewal: Subscriptions are billed on a recurring periodic basis (e.g., weekly, monthly, or annually) as specified at the time of purchase. Subscriptions automatically renew unless auto-renewal is turned off or canceled at least 24 hours before the end of the current billing period.
Payment Processing: Payment will be charged to your Google Play Account at confirmation of purchase.
Free Trials: If a free trial is offered, your subscription will automatically convert to a paid subscription at the end of the trial period unless canceled before the trial period ends.
Cancellation & Management: You can manage or cancel your subscription at any time through your Google Play Store Account Settings. Canceling a subscription stops future billing, but you will retain access to subscription features until the end of the current paid billing period.
C. Refunds
All purchases are processed directly by Google Play. Refund requests are subject to Google Play Refund Policies. We do not directly handle refunds or credit card chargebacks.
4. AI Content and Intellectual Property Rights
A. Your Content and Inputs
You retain ownership of any original text, photos, video clips, or audio files ("User Inputs") that you upload to or input into the App.
By uploading or submitting User Inputs, you grant us a non-exclusive, worldwide, royalty-free, temporary license to process, store, and modify your User Inputs solely for the purpose of generating your requested AI videos and operating the App.
B. AI Output
Subject to your compliance with these Terms, you are granted a non-exclusive, personal, or commercial right to download, store, use, and share the video content generated by the App ("Output"), to the extent permitted by applicable law and third-party provider policies.
You acknowledge that due to the nature of machine learning and AI processing, outputs may not be unique across different users and that identical or similar prompts may generate identical or similar outputs for other users.
C. App Ownership
The App, including its original source code, UI/UX design, software, graphics, logos, trademarks, and algorithms, is owned by TYCHE CONSULTANTS LTD and is protected by copyright, trademark, and other intellectual property laws.
5. Acceptable Use and Prohibited Conduct
You agree that you will NOT use the App to create, upload, generate, or share any content that:
Is unlawful, defamatory, libelous, harassing, abusive, threatening, harmful, or hateful.
Infringes upon any third party’s intellectual property, copyright, trademark, or privacy rights (including generating deepfakes or unauthorized likenesses of real individuals without their explicit consent).
Contains sexually explicit, pornographic, or obscene material.
Promotes violence, terrorism, illegal acts, or discrimination based on race, gender, religion, nationality, disability, or sexual orientation.
Involves the exploitation, abuse, or endangerment of minors in any form.
Is intended to deceive, misinform, impersonate others, or generate fraudulent/scam content.
We reserve the right, in our sole discretion, to terminate or restrict your access to the App without refund if you violate these rules or engage in misuse of our service.
6. Disclaimers and AI Limitations
"AS IS" Basis: The App and AI generation services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
AI Output Accuracy: We do not guarantee that the generated video content will always be accurate, realistic, appropriate, or error-free. AI technology may occasionally produce unexpected, distorted, or inaccurate results.
Service Availability: We do not warrant that the App will be uninterrupted, timely, secure, or bug-free.
7. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall TYCHE CONSULTANTS LTD, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, resulting from:
Your access to or use of (or inability to access or use) the App;
Any content or output generated through the App;
Unauthorized access to or alteration of your transmissions or content.
In no event shall our total liability for all claims exceeding the greater of $50 USD or the amount paid by you to us in the past six (6) months.
8. Indemnification
You agree to defend, indemnify, and hold harmless TYCHE CONSULTANTS LTD from and against any claims, damages, obligations, losses, liabilities, costs, or debt (including attorney's fees) arising from:
Your use of and access to the App;
Your violation of any term of these Terms;
Your violation of any third-party right, including copyright, property, or privacy right;
Any claim that your User Inputs or generated Output caused damage to a third party.
9. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the courts of London, United Kingdom.
10. Changes to Terms
We reserve the right to modify or replace these Terms at any time. We will post the revised Terms in the App or on our website with an updated "Last Updated" date. Your continued use of the App following any changes constitutes acceptance of the new Terms.
